These Terms govern ismyappslop.com (the "Site") and the website audit service offered on it (the "Service"). Is My App Slop is a BUILD product operated by Genius Guild LLC. By using the Site or buying the Service, you agree to these Terms and to our Privacy Policy.

1. Who we are

Genius Guild LLC ("we," "us") operates Is My App Slop and BUILD.

2. Eligibility

You must be at least 18 years old to buy the Service. The Site is not intended for children under 13.

3. What you are buying

The Service is a one-time, automated audit of the public website or web app URL you submit. You receive a written report that includes an overall score, scores across six dimensions, written observations, and suggested prompts you can use to improve your product. The Service is not a subscription, and it does not create an account.

4. Submitting a URL

When you submit a URL, you confirm that you own the site or have permission to submit it.

Is My App Slop reads only public pages. We do not log in to your site, bypass a login wall or paywall, or access anything that is not open to the public.

To produce your report, we send the public content of your page, including text and screenshots, to third-party services that retrieve and analyze it. Do not submit a URL if the public page contains information you do not want processed this way.

We may refuse or cancel any submission, including one that points to a private network address, appears intended to probe or attack a site, or involves unlawful content. If we cancel a submission, we will refund you in full.

5. Purchases and payments

Prices are in U.S. dollars unless stated otherwise. Stripe processes payments. By making a purchase, you authorize us and Stripe to charge your payment method for the amount shown at checkout, plus any applicable taxes.

6. Refunds

Your report is a digital product delivered as soon as it is ready, and it cannot be handed back. For that reason, sales are final once your report has been delivered. This includes cases where you disagree with a score, do not find the recommendations useful, or change your mind.

If we cannot deliver your report, we will refund you in full. That covers a payment that goes through without a report being delivered, and a site we cannot read, for example because of a login wall, a blocked crawler, or a site that is down.

If we cannot read your site, we will email you at the address you gave us. You can send us one corrected URL, and we will run the audit again at no charge. If that second attempt also fails, we will refund you in full.

Refunds go to your original payment method within 7 business days after we confirm the refund. To ask for one, email support@buildthedamnthing.com from the address you used to buy, and include the URL you submitted. If you were charged twice or charged the wrong amount, contact us and we will correct it once we verify the charge.

7. Delivery and your report

We deliver your report at a private link. Reports are usually ready within minutes, but timing can vary and is not guaranteed.

Anyone who has your report link can view your report, so keep the link safe. We keep your report and the information you submitted until you ask us to delete them. To make a deletion request, email support@buildthedamnthing.com.

8. Results are for information only

Your report is automated and AI-assisted. It is provided for information and education only.

Reports can be incomplete, inaccurate, out of date, or similar to reports produced for other sites. Scores and recommendations are opinions and estimates, not measurements or guarantees. We do not guarantee any result, including traffic, sales, conversions, search ranking, funding, security, or accessibility compliance.

Nothing in a report is legal, financial, accounting, security, accessibility, or other professional advice. A report is not a security test or an accessibility conformance audit. Before you act on anything in a report, consult qualified, licensed professionals for advice about your situation.

9. Intellectual property

We own the Site, the Service, and all content on them, except for content you submit. You keep your rights in your site and its content.

You may use your report and the prompts in it for your own business. We give you a limited, non-exclusive, non-transferable, revocable license to do so.

You may not: copy or resell the Service or reports of others; scrape or automate the Site; use the Site or reports to train AI models; remove notices; or use our names or marks without permission.

10. Acceptable use

You may not use the Site or the Service to: submit a site you have no right to submit; probe, attack, or overload any site or system; submit URLs in bulk or by automated means; submit unlawful content; or interfere with the Site.

11. Email

We use your email address to deliver your report, send receipts, and respond to support requests. If we send you news or offers from BUILD, you can unsubscribe at any time using the link in any such email. Emails about your order and your report will continue after you unsubscribe.

12. Third-party services

The Service relies on third parties, such as Stripe for payments, web crawling and AI services to read and analyze pages, hosting providers, and Google and Meta for analytics and advertising. We link to third-party sites. We do not control third parties and are not responsible for their content, products, or practices.

13. Disclaimers

The Site, the Service, and all content provided through them are offered "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent the law allows.

14. Limitation of liability

To the fullest extent the law allows, Genius Guild LLC and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Site or the Service.

Our total liability for any claim relating to the Site or the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. The refund described in Section 6 is not limited by this Section.

15. Indemnification

You will defend and indemnify Genius Guild LLC, Kathryn Finney, and our affiliates, officers, and employees against claims, losses, and expenses, including reasonable legal fees, arising from your use of the Service, the URLs you submit, or your violation of these Terms.

16. Suspension and termination

We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

17. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. Any dispute not subject to arbitration must be filed only in the state or federal courts located in Delaware.

18. Dispute resolution and arbitration

Before starting any formal proceeding, you agree to contact us at support@buildthedamnthing.com and try to resolve the dispute informally for at least 30 days.

If the dispute is not resolved, it will be decided by binding arbitration under the American Arbitration Association Consumer Arbitration Rules, except that either of us may seek injunctive relief in court for infringement or misuse of intellectual property.

You and we each agree that disputes will be resolved only on an individual basis, and not as a plaintiff or class member in any class or representative action.

19. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new date. If you keep using the Site after an update, you accept the updated Terms.

20. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Site and the Service. If a part of these Terms is found to be unenforceable, the rest stays in effect. You may not assign these Terms without our written consent.
